Welcome to Team Buffalo Outdoors, LLC (“Team Buffalo Outdoors,” “TBO,” “we,” “us,” or “our”). These Terms and Conditions (“Terms,” “Agreement”) constitute a legally binding agreement between you and Team Buffalo Outdoors, LLC, a New Jersey limited liability company, governing your access to and use of https://teambuffalooutdoors.com (the “Site”), including all associated products, content, subscriptions, services, and features offered through the Site (collectively, the “Services”).

BY ACCESSING OR USING THE SITE OR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE OR SERVICES.

1.1 Binding Agreement. By accessing, browsing, or using the Site or Services, you acknowledge you have read, understood, and agree to be bound by these Terms and the policies referenced herein, including our Privacy Policy, Cookie Policy, Return & Refund Policy, and Affiliate & Influencer Disclosure (collectively, the “Policies”), which are incorporated by reference.

1.2 Modifications. We may modify these Terms at any time in our sole discretion. Changes are effective upon posting to the Site. Your continued use after changes are posted constitutes acceptance of the revised Terms.

1.3 Additional Terms. Certain Services may be subject to additional terms presented at the time of use. Those terms are incorporated into these Terms by reference.

2.1 General Access. The Site and its content are available for general informational and entertainment purposes to users of all ages, subject to the restrictions below.

2.2 Age Requirement for Purchases and Marketing. You must be at least 18 years old to make a purchase or subscribe to marketing communications, including newsletters, promotions, and similar messages.

2.3 Representation. By completing a purchase or subscribing to marketing communications, you represent and warrant that you meet the requirement in Section 2.2.

3.1 Accounts May Be Offered. We may allow you to create an account to access certain features. If you create an account, you agree to provide accurate, current, and complete information and to keep it updated.

3.2 Account Security. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3.3 Account Termination. We may suspend or terminate your account or access to the Services at any time, with or without notice, if we believe you violated these Terms or for any other reason in our discretion.

4.1 Permitted Uses. You may use the Site and Services for lawful, personal, and non-commercial purposes unless otherwise expressly authorized in writing by Team Buffalo Outdoors, LLC.

4.2 Prohibited Activities. You agree NOT to:

a. Violate any applicable law or regulation
b. Infringe intellectual property, privacy, or other rights of Team Buffalo Outdoors, LLC or any third party
c. Transmit unlawful, abusive, defamatory, obscene, or otherwise harmful content
d. Transmit spam, unsolicited advertising, or unauthorized solicitations
e. Impersonate any person or entity or misrepresent affiliation
f. Attempt to gain unauthorized access to the Site, accounts, systems, or networks
g. Interfere with or disrupt the Site or Services
h. Use robots, spiders, scrapers, or automated means to access the Site without our express written permission
i. Introduce viruses, malware, or harmful code
j. Use the Site for fraudulent, deceptive, or harmful purposes
k. Harvest or collect personal information of others without permission
l. Reverse engineer or attempt to discover source code of the Site or Services

5.1 Ownership. All content on the Site (including text, images, videos, graphics, logos, designs, audio, software, trademarks, and other materials) (“Content”) is owned by or licensed to Team Buffalo Outdoors, LLC and protected under applicable intellectual property laws.

5.2 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Content for personal, non-commercial use.

5.3 Restrictions. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any Content without our prior written consent.

5.4 Trademarks. “Team Buffalo Outdoors,” “TBO,” and related names/logos are trademarks of Team Buffalo Outdoors, LLC. Unauthorized use is prohibited.

5.5 DMCA Notice / Copyright Agent. If you believe Content on the Site infringes your copyright, submit a notice to our designated agent:

Your notice should include: (i) identification of the copyrighted work claimed to be infringed, (ii) identification of the material claimed to be infringing and where it is located on the Site, (iii) your contact information, (iv) a statement that you have a good-faith belief the use is not authorized, (v) a statement under penalty of perjury that the information is accurate and you are the owner or authorized to act on the owner’s behalf, and (vi) your physical or electronic signature.

6.1 Submissions. The Site may allow you to submit reviews, comments, photos, videos, testimonials, or other content (“User Content”).

6.2 License Grant. By submitting User Content, you grant Team Buffalo Outdoors, LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, fully sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, publish, and otherwise exploit User Content for business purposes, including marketing and promotion.

6.3 Your Responsibilities. You represent and warrant you own or have the necessary rights and permissions to submit User Content and that it does not violate law or third-party rights.

6.4 Removal / No Obligation. We may remove User Content at any time for any reason without notice. We have no obligation to post or retain any User Content.

7.1 Inherent Risks. Outdoor recreational activities (including hunting, fishing, boating, hiking, camping, and use of outdoor equipment) involve inherent risks of property damage, serious personal injury, and death.

7.2 Assumption of Risk. BY USING THE SITE, PURCHASING PRODUCTS, OR FOLLOWING INFORMATION PROVIDED THROUGH THE SERVICES, YOU ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH OUTDOOR ACTIVITIES AND THE USE OF OUTDOOR EQUIPMENT.

7.3 Safety Responsibilities. You are solely responsible for your safety and decisions, including (without limitation):

• Inspecting equipment and products before use
• Following all manufacturer instructions and warnings
• Using products only as intended
• Understanding local laws, regulations, licensing, and safety requirements applicable to your activities
• Assessing weather, terrain, and your physical condition before participating in outdoor activities

7.4 No Professional Advice. Content is for informational and entertainment purposes only and does not constitute professional advice.

8.1 Availability. Products and Services are subject to availability. We may limit quantities, discontinue items, or refuse orders in our discretion.

8.2 Pricing. Prices are listed in USD unless otherwise stated and may change without notice. We are not liable for typographical or pricing errors.

8.3 Order Acceptance. Order confirmations do not guarantee acceptance. We may cancel orders due to unavailability, errors, suspected fraud, or payment issues.

8.4 Payment Processing. Payments are processed by third-party providers. We do not store full payment card details.

8.5 Taxes. You are responsible for applicable taxes and governmental charges unless otherwise stated.

9.1 Shipping Times. Shipping times are estimates and not guaranteed. Delays may occur due to carriers, weather, or other factors beyond our control.

9.2 Risk of Loss. To the extent permitted by law, risk of loss and title pass to you upon delivery to the carrier.

9.3 Accurate Address. You are responsible for providing an accurate delivery address.

9.4 Issues Upon Delivery. Please report missing items or shipping damage to us within 7 days of delivery.

10.1 30-Day Return Policy. We offer a 30-day return policy for eligible items, subject to these conditions:

• Return request must be made within 30 days of delivery
• Items must be unused, unworn, and in original condition
• Items must include original packaging and tags (if applicable)
• Proof of purchase may be required

10.2 Non-Returnable Items. The following are not returnable:

• Gift cards
• Digital products (if any)
• Final sale/clearance items (if marked “final sale”)
• Any item that is used, worn, washed, damaged after delivery, or returned without original components when applicable

10.3 Return Shipping. Unless the return is due to our error (wrong item shipped or defective item), return shipping is the customer’s responsibility.

10.4 Refund Timing. If approved, refunds are issued to the original payment method within 10 business days after we receive and inspect the returned item(s). Shipping charges are non-refundable unless the item is defective or we made an error.

10.5 Defective or Incorrect Items. If your item arrives defective or incorrect, contact us promptly for assistance.

10.6 Amazon Purchases. Items purchased through our Amazon storefront must be returned through Amazon and are subject to Amazon’s return policies. We cannot process returns for Amazon orders.

11.1 Affiliate Relationships. We participate in affiliate marketing and may earn commissions from qualifying purchases through certain links, including Amazon-related links when applicable.

11.2 Influencer Partnerships. We may work with influencers/ambassadors who promote our products in exchange for compensation, free products, or commissions.

11.3 FTC Compliance. Partners are required to follow FTC disclosure guidelines. We are not responsible for third-party statements or claims.

11.4 Tracking. Affiliate referrals may be tracked through cookies, links, discount codes, or similar attribution technologies.

12.1 Third-Party Platforms. We maintain a presence on platforms such as YouTube, Instagram, Facebook and social media. Your use of those platforms is governed by their terms and policies.

12.2 Third-Party Links. Links to third-party websites are provided for convenience. We do not control or endorse third-party content and are not responsible for it.

13.1 Consent. By subscribing to our newsletter or otherwise opting in, you consent to receive marketing communications from Team Buffalo Outdoors, LLC.

13.2 Unsubscribe. You can unsubscribe at any time using the unsubscribe link in an email.

13.3 Transactional Emails. Even if you unsubscribe from marketing, you may still receive transactional messages related to purchases or customer service.

14.1 Privacy Policy. Our collection and use of personal information is described in our Privacy Policy, available on the Site. It explains what data we collect, how we use it, and how you may request access, correction, or deletion of your personal information where required by law (including under GDPR and CCPA/CPRA).

14.2 Cookies. We use cookies and similar technologies as described in our Cookie Policy, available on the Site.

15.1 AS IS. THE SITE, SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

15.2 No Guarantees. We do not guarantee the Site will be uninterrupted, error-free, or secure, or that content is complete or current.

15.3 Outdoor Activity Disclaimer. TEAM BUFFALO OUTDOORS, LLC MAKES NO WARRANTIES REGARDING THE SAFETY, SUITABILITY, OR APPROPRIATENESS OF ANY PRODUCTS, INFORMATION, OR RECOMMENDATIONS FOR YOUR INTENDED USE OR OUTDOOR ACTIVITIES. YOU ASSUME ALL RISKS ASSOCIATED WITH OUTDOOR RECREATION.

16.1 Exclusion of Damages. TO THE FULLEST EXTENT PERMITTED BY LAW, TEAM BUFFALO OUTDOORS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, SERVICES, OR PRODUCTS.

16.2 Outdoor Injury / Death Disclaimer. TO THE FULLEST EXTENT PERMITTED BY LAW, TEAM BUFFALO OUTDOORS, LLC WILL NOT BE LIABLE FOR ANY INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO OUTDOOR ACTIVITIES OR THE USE OR MISUSE OF PRODUCTS, INCLUDING CLAIMS ALLEGING NEGLIGENCE, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

16.3 Cap on Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF TEAM BUFFALO OUTDOORS, LLC FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, THE SERVICES, OR ANY PRODUCT SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID TO TEAM BUFFALO OUTDOORS, LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR
(b) $100.

16.4 Fundamental Basis of the Bargain. You acknowledge that the disclaimers and limitations in these Terms are fundamental to the bargain between you and Team Buffalo Outdoors, LLC and that we would not be able to provide the Site or Services on an economically reasonable basis without them.

16.5 Jurisdictional Limits. Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Team Buffalo Outdoors, LLC from claims arising out of your use of the Site, violation of these Terms, infringement of third-party rights, User Content, or misuse of products.

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for any reason, including suspected violations of these Terms.

Survival. Sections 5, 6, 7, 15, 16, 17, 19, and 20 survive termination.

19.1 Governing Law. These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law rules.

19.2 Venue. Unless prohibited by applicable law, any dispute will be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts.

20.1 Entire Agreement. These Terms and incorporated Policies constitute the entire agreement between you and Team Buffalo Outdoors, LLC regarding the Site and Services.

20.2 Severability. If any provision is unenforceable, the remainder remains effective.

20.3 No Waiver. Failure to enforce any provision is not a waiver.

20.4 Assignment. You may not assign your rights under these Terms without our consent. We may assign ours.

20.5 Force Majeure. We are not liable for failures due to causes beyond our reasonable control.
